TO: UNITED STATES INSTALLMENT REALTY COMPANY, A MINNESOTA CORPORATION, AND ITS SUCCESSORS, KNOWN AND UNKNOWN; THE KNOWN AND UNKNOWN STOCKHOLDERS OF UNITED STATES INSTALLMENT REALTY COMPANY, A MINNESOTA CORPORATION, AS OF THE DATE ON WHICH SAID CORPORATION WAS DISSOLVED, TERMINATED OR OTHERWISE CEASED DOING BUSINESS, AND THEIR SUCCESSORS, KNOWN AND UNKNOWN; U.S.I. REALTY COMPANY, A MINNESOTA CORPORATION, AND ITS SUCCESSORS, KNOWN AND UNKNOWN; AND THE KNOWN AND UNKNOWN STOCKHOLDERS OF U.S.I. REALTY COMPANY, A MINNESOTA CORPORATION, AS OF THE DATE ON WHICH SAID CORPORATION WAS DISSOLVED, TERMINATED OR OTHERWISE CEASED DOING BUSINESS, AND THEIR SUCCESSORS, KNOWN AND UNKNOWN, Defendants in the cause herein described.
You and each of you are hereby commanded to appear and answer before the 343rd Judicial District Court in the Live Oak County Courthouse in George West, Live Oak County, Texas, at or before 10:00 a.m. on the first Monday after the expiration of forty-two (42) days from the date of issuance hereof, being at or before 10:00 a.m. on Monday, the 8th day of April, 2013, then and there to answer the petition of PIONEER NATURAL RESOURCES USA, INC., in Cause No. L-13-0032-CV-C, styled “PIONEER NATURAL RESOURCES USA, INC. vs. UNITED STATES INSTALLMENT REALTY COMPANY, ET AL.” wherein the said PIONEER NATURAL RESOURCES USA, INC. is Plaintiff, and the said UNITED STATES INSTALLMENT REALTY COMPANY, ET AL., are Defendants. The said petition, filed on the 11th day of February, 2013, discloses that the nature of said suit is as follows:
This suit is brought to have a receiver appointed under the provisions of Section 64.091(b) of the Texas Civil Practice and Remedies Code for an undivided fifty percent (50%) mineral interest owned by the Defendants in and to the following described land situated entirely in Live Oak County, Texas, to-wit:
120.00 acres of land, more or less, out of the R. H. Brown Survey, Abstract No. 891, Live Oak County, Texas, more particularly described as being all of Lots 8-13 and 23-28 out of Block 3, Live Bee Land Subdivision No. 2, as described in that certain Plat recorded in Volume 1, Page 16 of the Plat Records of Live Oak County, Texas;
and as Receiver to execute and deliver to the Plaintiff, as lessee, an Oil, Gas and Mineral Lease covering said interest in said land, and take such other action deemed necessary under the provisions of said statute.
If this citation is not served within ninety (90) days after the date of its issuance, it shall be returned unserved.
