Murder trial postponed until May

BEEVILLE – Richard Longoria, the brother of the man arrested following a high speed car chase Monday, has another delay in his murder trial — this time until May 12.

Longoria and Andrew Clay Lopez are both charged with the fatal shooting of Alex Longoria while he was at Kohler (Nopal) Park last August.

This postponement came Tuesday afternoon in court only a week before it was set for trial.

This is at least the second time the trial has been postponed.

According to court documents filed Feb. 14, the trial was postponed because some of the evidence examination had not been completed.

According to this motion for continuance, “The state is waiting for lab results on fingerprints, ballistics on a found casing and weapon and gunshot residue.

“Results are expected by March 18, 2014.”

According to the indictments, Lopez was driving a vehicle in which Richard Longoria was a passenger on Aug. 18, 2013, when the vehicle pulled up on the north side of Kohler Park.

Police have said Lopez stayed behind the wheel of the 1997 Camaro while Longoria stepped out with a .22-caliber rifle.

According to investigators, Longoria already had fired at his intended victim, 21-year-old Alex Longoria, before the vehicle came to a complete stop. After getting out of the vehicle, Richard Longoria continued firing at him until he was sure he had hit him.

The victim was hit once in the stomach, and he died of that wound.

BPD officers found the shooting suspect in a home in the 1700 block of Emily Drive about four hours later.

Lopez was later arrested in Houston.

Longoria is also being held on charges of being a felon in possession of a firearm.

The felon in possession of a firearm charge was filed against Longoria because he allegedly had a firearm on Aug. 18, less than five years after being released from supervision by the Texas Department of Criminal Justice.
