Roger Capistran of Goliad was indicted with an assault charge of choking Heather Rodriguez of Victoria at his residence on Oak Forest Road in February. A jury in the 24th District Court announced its unanimous verdict of not guilty that acquitted Capistran of all charges after arguments ended Wednesday.
