Newly appointed grand jurors indicted Marcos Villagomez on a charge of attempted sexual assault. The charge was enhanced to a punishment range of 25-99 years or life in prison because Villagomez had previous felony convictions.
According to investigators with the Beeville Police Department, Villagomez pulled down a 27-year-old woman’s shorts in an attempt to sexually assault her on Sept, 12, 2009.
The punishment range of the indictment was enhanced because the defendant had been convicted of burglary of a habitation on Sept. 2, 1999, and on a charge of possession of cocaine with intent to deliver on April 19, 2000. Both convictions were in Harris County.
District Judge Janna Whatley set bond at $5,000.
Others indicted Tuesday included:
•Steven Ray Martin on a charge of indecency with a child, a second degree felony.
If convicted, Martin could be sentenced to 20 years in prison and fined $10,000.
Bee County Sheriff’s Office investigators alleged that the defendant inappropriately touched a girl under the age of 17 on April 1, 2008.
Bond was $25,000.
•Zachary Sutherland was named in a two-count indictment on charges of injury to a child.
According to police, Sutherland spanked a girl under the age of 14 on her genitals and buttocks on Aug. 7, 2009.
Bond was $10,000.
•Gerard Guerrero on a charge of driving while intoxicated, a third degree felony.
Guerrero faces 10 years in prison and a $10,000 fine if convicted of the offense.
BPD officers alleged that the defendant was operating a motor vehicle while under the influence of alcohol on Sept. 19, 2009.
Bond was $5,000.
•Roel Cerda on a charge of possession of a prohibited substance in a correctional facility, enhanced to a third degree felony.
Texas Department of Criminal Justice investigators claimed that Cerda had marijuana in his possession at the William G. McConnell Unit on Aug. 21, 2008.
Cerda had a previous felony conviction on a charge of intoxication manslaughter in Hidalgo County on Aug. 23, 2002.
Bond was $10,000
•Gregory Stevenson on a charge of possession of a deadly weapon in a penal institution, enhanced to a third degree felony.
TDCJ investigators alleged that the defendant had a sharpened metal rod with cloth wrapped on one end in his possession on Sept. 8, 2009, at the McConnell Unit.
He had previous felony convictions on a charge of assault on a public servant in Brown County on March 12, 2003, and on two counts of burglary of a habitation and one count of assault on a public servant on April 18, 2008. All of the last three convictions were in Tarrant County.
Bond was $10,000.
