Dieringer of Three Rivers arrested for allegedly discharging a firearm in city limits, resisting arrest

David Dwayne Dieringer, 30, of Three Rivers was arrested on Wednesday, Jan. 6, for allegedly discharging a firearm in the city limits and resisting arrest.

Live Oak County sheriff’s dispatchers received a call just after midnight on Wednesday from one of Dieringer’s neighbors requesting an officer be dispatched to Windy Lane because he “heard loud music and some shots or fireworks going off.”

Three Rivers Police Officer Rey Medrano arrived at the scene and found a man, later identified as Dieringer, sitting in his pickup truck. “The vehicle was in the driveway and in the park position. Dieringer appeared to be passed out in the driver seat of his vehicle. I observed he had his music at a very loud degree. I also observed a strong odor of alcohol coming from his breath and several beer cans on the seat,” Medrano stated.

“I spoke to Dieringer and advised him to turn down the music and go inside for the remainder of the evening. Then I left at approximately 1:20 a.m.,” Medrano continued.

Around 2:58 a.m. dispatchers received more calls from other neighbors and from the Three Rivers Nursing Home alleging they heard popping noises again.

Medrano drove back toward Dieringer’s home. “At approximately 3 a.m., I heard a single shot being fired. I heard what sounded like a shotgun. I then drove my patrol unit checking the area in which the gunshot was coming from. I was on Hwy. 72 E. facing Windy Lane when I observed Dieringer walk outside to the back porch, raise with both hands a rifle and discharge it into the air,” Medrano alleged.

Backup officers were dispatched to Dieringer’s home. Live Oak County Deputy Bruce Parons and Three Rivers Officer William Jones responded.

Medrano said he attempted to make contact with Dieringer by knocking and ringing the door bell. After several minutes, Dieringer finally answered the door, Medrano said.

Dieringer then tried to shut the door several times, Medrano claimed. “I instructed Dieringer to stay where he was. He then turned and began to walk towards the kitchen out of my view. I continued to ask Dieringer several times to show me his hands and step outside. Dieringer continued to pace back and forth. Dieringer failed to comply with my instructions,” Medrano added.

According to the police incident report, when Medrano and Deputy Parsons were trying to handcuff Dieringer, he allegedly pulled his hands away in an aggressive manner and raised them as if to strike Medrano. However, hand restraints were finally placed on Dieringer.

Jones assisted Medrano in securing the home of firearms. According to the police incident report, when the officers walked through the bedroom area to the back porch, they found a single-shot .410 shotgun with a spent shell case still in the chamber.

“I observed a strong odor of gunpowder coming from the shotgun as it would be after being discharged. Dieringer had the same odor coming from his hands,” Medrano claimed.

Dieringer was arrested for discharging a firearm in certain municipalities and for resisting arrest. He was transported to the Live Oak County jail.

Dieringer was magistrated by Pct. 3 Justice of the Peace Jim Lane. Bond was set at $5,000 for the firearm charge; an additional $5,000 bond was set for the resisting arrest charge.
