The Live Oak County Grand Jury convened on Jan. 14 and indicted 16 individuals. Three of them were indicted on two or more counts.
John Lee Daniels, 51, and Loretta Hendrix, 43, were indicted for burglary of a habitation.
Live Oak County Sheriff Larry Busby said, “This was a result of a burglary in progress in Lagarto on Ranger Road on May 24, 2009.”
“Allegedly Hendrix came to the door to distract the victim by standing on the porch engaging her [the victim] in small talk while Daniels allegedly tried to enter the residence from a back window. He alledgedly tore a window screen and knocked over a number of items, including a lamp, in his attempt to enter. The victim said she heard noise from the back part of her house. There was no one else in the house,” Busby said.
Allegedly Daniels changed his mind because he ran off. Deputy J. Calaway saw Daniels and Hendrix walking down a road. The victim advised she was able to name the two burglary subjects.
“Calaway encountered them and arrested them. Daniels was magistrated and bond was set at $10,000. He was released on May 27 after posting the bond. Upon indictment District Judge Janna Whatley continued him on the same bond.
Michael Garces, 34, of George West was indicted on three counts of credit card abuse. “A George West man reported unauthorized charges on his credit card. He said he suspected an ex-employee and turned over the evidence to Live Oak County Investigator Charlie Stroleny,” Busby said.
Allegedly, Garces used the credit card at a discount store in Beeville more than once. He also used the credit card at two dining establishments in George West and a convenience store. “Our investigator was able to track down several items, including a Sony game player,” continued Busby.
After an investigation by Stroleny, Pct. 2 Justice of the Peace Virginia Tanguma issued a warrant for Garces’ arrest. He was subsequently arrested on Sept. 2 by Officer Mike Ferrell. He was magistrated by Pct. 1 Justice of the Peace Elizabeth Ellis. She set bond at $15,000. He posted bond on Sept. 8 and was released. Upon indictment Judge Whatley continued him on the same bond.
Sandra Ann Cortinas, 24, of George West was indicted for debit card abuse. Cortinas was arrested on July 20 at 6 p.m. by George West Police Chief Ray Garcia and Officer Juan Garcia. She was magistrated by Ellis; bond was set at $10,000. Cortinas posted bond and was released. Upon indictment Whatley continued her on the same bond.
Shane D. Kuhlmann, 35, John Prentice Turnbull, 37, and Charles Edward Williams, 40, all from Austin, were indicted for possession of a controlled substance PG3-Diazepam (28G-200G). The trio were arrested on Jan. 10, 2009, by Chief Ray Garcia, and George West Police officers Jorge Morin and R. Meakins after it was determined they were in possession of a substance believed to be diazepam.
Kuhlmann, Turnbull and Williams were magistrated by Pct. 4 Justice of the Peace Endercio Chapa, Jr. He set bond at $6,500 each. The next day all three men (Kuhlmann, Turnbull and Williams) posted bond and were released. Upon indictment Whatley continued the trio on the same bonds.
Marco Francisco Torres, 34, of Corpus Christi was indicted for possession of a controlled substance, PG 3, with intent to deliver (28G<200G). Torres was arrested July 26 at 7:50 p.m. by Ray Garcia, Meakins and Trooper Clarence Lewinski after it was determined he was in possession of material believed to be a controlled substance. Upon indictment Whatley continued him on the same bond.
Jose Angel Gutierrez, 54, of McAllen was indicted on two counts of theft – count 1 theft of $1,500-$20,000 and count 2 theft of $20,000-$100,000. He was arrested on July 22 by Three Rivers Police Chief Vance Roberts and Cpl. J.R, Rodriguez after an investigation of theft of services.
After Gutierrez spent 90 days in jail he was released him on personal recognizance. Upon indictment Whatley issued a capias for Gutierrez’s arrest with a $10,000 bond.
B.J. Jarratt, 29, of Three Rivers was indicted for injury to a child. Jarratt was arrested on Nov. 9 at 10:53 a.m. by Three Rivers Police Officer Clint Davis. Jarratt was magistrated by George West Municipal Judge Patricia Lanford. She set bond at $12,000. Upon indictment Whatley continued Jarratt on the same bond.
Scott Crispell Binder, 45, Humble was indicted for unauthorized use of a motor vehicle. Binder was arrested on Aug. 20 at 4 a.m. by Trooper C. Wallace. He was magistrated by Lanford; she set bond at $10,000. He posted bond on Aug. 25 and was released. Upon indictment Whatley continued him on the same bond.
Steven Brian Davis was indicted on two counts - count 1 evading arrest with a motor vehicle and count 2 unauthorized use of a motor vehicle. “Davis was not arrested at the scene as he was in a motorcycle wreck,” said Busby. A capias has been issued for his arrest with a $5000 bond.
Esteban Gonzalez, 28, of Rio Grande City was indicted for possession of marijuana (50 lbs.-2,000 lbs.). Gonzalez was arrested on July 25 at 10:37 p.m. by Trooper Jason Galvan after it was determined he was in possession of a substance believed to be marijuana.
Bond was set at $40,000. Gonzalez was not able to post bond. After Gonzalez spent 90 days in jail District Judge Joel B. Johnson released him on personal recognizance. Upon indictment Whatley issued a capias for Gonzalez’s arrest with a $15,000 bond.
Terry Wayne Vahalik, 43, of Alice was indicted for driving while intoxicated. Vahalik was arrested on July 18 at 4:48 a.m. by Trooper Garcia for suspicion of driving while intoxicated.
He was magistrated by Ellis. She set bond at $10,000 and he was released that afternoon at 3:15 p.m. Upon indictment Whatley continued him on the same bond.
John Arthur Bonnell, 57, of Laredo was indicted for driving while intoxicated. Bonnell was arrested on March 19 by Trooper Lewinski on suspicion of driving while intoxicated. During the booking process, it was determined this was Bonnell’s third or more time to be charged with DWI.
Alfred Kelly Goforth and Mario Perez Ochoa were indicted for bail jumping because they failed to appear in court on other charges. Judge Whatley issued a capias for their arrests with a $20,000 bond each.
