A 54-year-old man faces 99 years to life in prison and a $10,000 fine if he is convicted of a felony drug charge filed when he was arrested by a deputy on Jan. 29.

Deputy Brandon Burdick reported that he was on patrol at 9:09 p.m. when he noticed a southbound 1995 Dodge truck crossing the center stripe and then weaving back to the shoulder of the highway on U.S. 181 just south of Povlish Road.

When Burdick approached the vehicle, he smelled alcohol in the truck and on the driver’s breath, the deputy reported.

Burdick took a driver’s license from him and identified him as Donald Garrett of Skidmore. Burdick then asked him to step out of the vehicle.

The deputy saw what appeared to be a mixed drink in a plastic cup inside a holder in the vehicle.

Burdick spoke to a female passenger in the vehicle and she admitted that the drink in the cup holder contained alcohol, but she said it was Garrett’s first drink.

The deputy asked the woman in the passenger seat to hand the drink to him and as she did Burdick noticed a tear in the fabric of the driver’s seat and inside the tear was a clear, plastic bag that contained several smaller plastic bags.

Burdick noticed that each of the smaller bags contained a white powdery substance and it was probably cocaine packaged for sale and distribution.

The deputy ordered the passenger to put her hands on the dashboard and keep them there. He took the bags from the hole in the seat, turned and handcuffed Garrett, telling him he was under arrest.

Burdick then searched Garrett and took a pocketknife and $472 in cash from the suspect. When he checked the knife, the deputy noticed what appeared to be a white powder on the blade.

When Burdick performed a field test on the powder, it showed a positive result indicating that it was cocaine.

The deputy had the female step out of the vehicle and she denied having anything to do with the drugs in the plastic bags. Although she and Garrett both were registered as owners of the vehicle, Deputy Lt. Steve Linam, the Bee County Sheriff’s Office chief investigator, had Burdick release her, pending further investigation.

Garrett was taken to the Bee County Jail, booked on a charge of manufacture and delivery of a controlled substance, cocaine, more than four grams but less than 200 grams.

The offense is a first degree felony.

Garrett’s vehicle was impounded and he was placed in a cell.

Justice of the Peace Raul Casarez set bond on the suspect at $5,000 and he was released on bond the following day.

Deputies reported that Garrett had 8.8 grams of the drug with him when he was arrested.

During a search of Garrett’s clothing, deputies found another $191 and put that with the other money they had confiscated. Jailers also took control of a Motorola cellular phone as evidence and to help them with the investigation.
