Beeville man, 39, indicted on charges of sexual assault of a juvenile relative

A 39-year-old Beeville man faces a possible life sentence if he is convicted of the more serious of four counts cited in an indictment returned last Thursday.

According to Detective Lt. Rene Guerrero of the Beeville Police Department, Frank DeLeon Jr. was accused of two counts of sexual assault of a child and two counts of prohibited sexual conduct, all stemming from an Aug. 17, 2009, incident involving a girl under the age of 17.

The indictment alleges that the victim was a close relative of the defendant.

The first two counts were enhanced from second to first degree felonies, punishable by prison terms of up to 99 years or life and fines of $10,000.

The two counts of prohibited sexual conduct were enhanced from third degree felonies to second degree felonies, which could get the defendant a prison terms of 20 years and $10,000 fines for each count.

Each of the charges was enhanced because DeLeon had a previous felony conviction on a charge of burglary of a habitation in Karnes County on May 16, 2005.

According to the language of the indictment, DeLeon engaged in various forms of sexual contact with the victim on the day cited in the indictment.

District Judge Joel Johnson set bond on the defendant at $50,000.

Others indicted on felony charges by the Bee County Grand Jury on Thursday were;

•Juan Villarreal Jr., also known as Juan Villarial Jr.

He was named in a two-count indictment on a charge of burglary of a habitation with intent to commit assault, a second degree felony, and aggravated assault, threat, with a deadly weapon.

Investigators alleged that Villarreal entered the home of a local woman on July 2 and told her he would kill her while exhibiting a pistol. That charge was the first degree felony.

The other incident reportedly took place on July 26 when he entered the same victim’s home to assault her. That charge was the second degree felony.

Bond was $20,000.

Villarreal also was named in another two-count indictment on charges of burglary of a habitation, both second degree felonies.

Beeville police alleged that the defendant broke into the home of the same victim to assault a man living there and to commit the act of felony criminal mischief.

That incident reportedly took place on Sept. 5, 2009.

Bond on that indictment also was $20,000.

•Eugene Martinez was named in a four-count indictment on charges of aggravated assault with a deadly weapon, aggravated assault with serious bodily injury, aggravated assault, threat, with a deadly weapon and retaliation.

The first three counts cited in the indictment were second degree felonies and the third count was a third degree felony.

A third degree felony conviction could put Martinez behind bars for up to ten years and cost him a $10,000 fine.

According to investigators at the Bee County Sheriff’s Office, Martinez attacked a local man on Aug. 21, 2009, and hit him with a bat, causing injury, and then threatened him with a knife.

The fourth count of the indictment was the result of a verbal threat that the defendant allegedly made after the incident when he said he was going to beat the victim and kill him for reporting a crime.

Bond was $5,000.

•Daniel Treviño on a charge of aggravated assault, bodily injury.

The offense is a second degree felony.

BPD officers alleged that the defendant stabbed a man in the stomach on Sept. 19, 2009.

Bond was $15,000.

•Ramiro Canas in a two-count indictment on charges of indecency with a child, contact. Both charges are second degree felonies.

BPD investigators claimed that Canas touched the genitals of a girl under the age of 17 in two incidents, one on Jan. 11, 2003, and another on Feb. 15, 2003.

Bond was $10,000.

•Jonathan Paul Morrow on a charge of sexual assault of a child, a second degree felony.

County investigators said the defendant had sex with a girl under the age of 17 on Nov. 6, 2008.

Bond was $10,000.

•Douglas Keith Serreno on a charge of sexual assault, a second degree felony.

According to Bee deputies, Serreno had sex with a female on Dec. 16, 2008.

Bond was $10,000.

•Steven Cruz in a two-count indictment on charges of burglary of a habitation with intent to commit assault.

Deputies claimed that Cruz broke into the home of a local man on Dec. 15, 2009, to assault two people in the residence.

Bond was $10,000.

•Lazaro Olivares on a charge of felony driving while intoxicated.

The offense normally is a third degree felony, punishable by a prison term of 10 years and a $10,000 fine.

However, the charge was enhanced to a second degree felony because Olivares had a previous felony DWI conviction on Nov. 30, 2004, in Bee County.

According to BPD officers, Olivares was charged with the latest DWI on June 27, 2008.

He had previous DWI convictions on Feb. 18, 1993, in Dallas County and on Aug. 5, 1999, in Bee County.

Bond was $2,500.

•Michael Villegas on a charge of theft, a third degree felony.

According to BPD investigators, the defendant took insulated copper wire worth less than $20,000 from an air conditioning contractor.

Bond was $5,000.

•Rosita Treviño in a two-count indictment on charges of assault against a public servant and retaliation.

Both charges are third degree felonies.

BPD investigators claimed that Treviño punched a BPD officer in the chest during an incident on July 6, 2009, and that she threatened retaliation by telling him, “Once I get out I’m going to find you and slice you.”

Bond was $2,000.

•Justin Dwan Lewis on a charge of possession of a prohibited substance in a correctional facility.

The charge is a third degree felony.

Bee County deputies alleged that Lewis had marijuana in his possession while at the Bee County Jail on Oct. 20, 2009.

Bond was $1,500.

•Steven Cruz on a charge of unauthorized use of a motor vehicle, a state jail felony, punishable by a two-year term in a state jail facility and a fine of $10,000.

Deputies claimed that the defendant took a woman’s vehicle without her permission on Dec. 15, 2009.

Bond was $5,000.

•Juan Huerta Cardosa Jr. on a charge of possession of a controlled substance, cocaine, less than one gram.

The offense is a state jail felony.

Sheriff’s office investigators claimed that Cardosa had the drug on Feb. 13, 2009.

Bond was $2,500.
