Deputy calls death of 3-year-old boy ‘a tragic accident’

BEEVILLE — Deputy Lt. John Davis, Bee County Sheriff’s Office chief investigator, said he believes no one was at fault in the Saturday evening death of a 3-year-old boy.

“It was just a tragic accident,” Davis said. “No charges have been filed, and none are expected,” Davis said Monday.

The accident occurred at a private residence on Wildcat Drive off FM Road 673 at about 5:30 p.m., Davis said.

The victim, identified as Carlos Valdemar Gutierrez, was among a group of family members attending a birthday party, and one of the guests got into a vehicle and backed out to leave.

The driver never realized that the victim was behind the vehicle.

Emergency Medical Service personnel from Angel Care Ambulance Service arrived and rushed the boy to Christus Spohn Hospital Beeville where he was pronounced dead on arrival.

Davis said the boy’s body was taken to Corpus Christi for an autopsy, and the case will be reviewed by the Bee County Grand Jury at a later date.

Davis said a grand jury review of the evidence is simply a formality in such cases. He said he did not expect any charges to come from the review.

Deputy Investigator Adam Levine was in charge of the investigation at the scene, and he was assisted by Deputy Sgt. Kevin Behr. Highway Patrol Trooper Kolton Kendall also assisted at the scene.
