A jury needed just over one hour on May 21 to find Eleazar Luna guilty on all three indictments alleging him of engaging in inappropriate sexual conduct with a 9-year-old Goliad girl.
Sentencing for Luna has been set for July 1 before Judge Stephen Williams. He faces a penalty of 2 to 10 years in prison and a fine of up to $10,000 on each charge.
Assistant District Attorney Terry Breen said he will call at least one witness to testify during the July 1 sentencing.
Breen said girl’s family moved next door to Luna in August 2011.
“There were really no children in the neighborhood,” Breen said. “They became very close to Eleazar Luna and his girlfriend, who lived with him. He would invite them over for barbecues.”
Breen said Luna began exposing himself to the girl during the summer of 2012.
“She said he asked her if she’d like to learn about sex,” Breen said. “He started showing her episodes from ‘Jersey Shore.’ From that, he moved on to porno and would show it to her on his iPhone. Then he eventually started exposing himself to her and asked her to expose herself to him. She did so because she said she was afraid not to.”
Breen said the girl quit going to Luna’s residence in November of 2012. According to Breen, the girl made inappropriate sexual comments to a schoolmate, who informed a teacher. Breen said the girl’s principal called her in and the girl explained what had happened to her at Luna’s residence.
Breen said the girl testified how Luna fondled himself while she exposed herself to him.
“We had to take her off the stand because she broke down while describing that,” Breen said.
The girl said she never had direct physical contact with Luna.
A search warrant executed by sheriff’s deputies at Luna’s residence found pornographic videos and miscellaneous paraphernalia described by the girl.
