Woman accused of driving too fast; charged with death of passenger

Bee County grand jurors returned several indictments on Dec. 18, naming defendants in second and third degree felony cases and in state jail felony cases.

They were:

•Deandra Denise Montalvo on a charge of manslaughter, a second degree felony.

If convicted, the defendant could face a prison term of from two to 20 years and a fine of as much as $10,000.

Highway Patrol Trooper Randy Aguirre investigated a July 27, 2007, incident in which he alleged that the defendant caused the death of another woman by driving too fast, causing her vehicle to roll over and kill the victim.

District Judge Janna Whatley set bond on the defendant at $10,000.

•Emilio Gomez on a charge of possession of a controlled substance, cocaine, less than one gram.

The charge was enhanced to a second degree felony because Gomez had previous felony convictions.

According to the indictment, Gomez was convicted of a charge of burglary with enhancement on July 19, 1982, and on another charge of burglary with enhancement on Jan. 12, 1989, both in Bee County.

The document also included a conviction on a charge of burglary with intent to commit theft on Sept. 21, 1993, in Harris County.

Bond was $500.

•Richard Lee Rosenbaum in a two-count indictment on charges of injury to a child.

Both counts are third degree felonies. If convicted, Rosenbaum could be sentenced to prison terms of from two to ten years and a fine of $10,000 for each alleged offense.

Bee County Sheriff’s Office investigators alleged that the defendant beat a child under the age of 14 with a belt on May 24 and again on May 25.

Bond was $2,500.

•Homero Maldonado on a charge of bail jumping, a third degree felony.

Bee County District Court bailiff Tom Brown alleged that Maldonado failed to appear in court on Nov. 25, when he was scheduled for a hearing on a third degree felony charge of DWI.

Bond was $25,000.

•Elizabeth DeLaGarza on a charge of DWI, a third degree felony.

Beeville police alleged that the defendant was driving under the influence of alcohol or a controlled substance on Oct. 21.

The indictment showed that DeLaGarza had previous DWI convictions on May 19, 1999, and on Oct. 31, 2005, both in Bee County.

•Richard J. Hinojosa on a charge of DWI, a third degree felony.

Highway Patrol Trooper Santiago Montez arrested the defendant with the offense on Aug. 9.

The indictment listed three previous DWI convictions, on Jan. 30, 1980, on Aug. 20, 1982, and on Aug. 22, 2001, all in Bee County.

Bond was $2,500.

•Catherine Celine Garcia and Tammy Marie Potter on charges of fraudulent use of identifying information, fewer than five.

The offense is a state jail felony.

According to police, the two women were found to have used an electronic identification number, a Navy-Army Federal Credit Union account number and a driver’s license number of another woman on Aug. 7 and Aug. 21, 2007.

Bond was $2,000 for each defendant.

•John Paul Canales on a charge of DWI with a passenger under the age of 15, two counts.

The offense is a state jail felony, punishable by a term of from six months to two years in a state jail facility and a fine of as much as $10,000.

Deputies accused the defendant of driving under the influence of alcohol or a controlled substance on Feb. 1 when he had two children in the vehicle with him.

Bail was $2,500.

•Amanda T. Lane on a charge of DWI with a passenger under the age of 15, four counts.

Trooper Montez alleged that Lane had four children in the vehicle with her when she was arrested on a DWI charge on May 17.

Bond was $1,000.

•Ramon Martinez Rodriguez on a charge of DWI with a child under the age of 15 in the vehicle, a state jail felony.

Deputies claimed that Rodriguez committed the offense on April 12.

Bond was $1,000.

Ironically, that was not the only charge of DWI with a child under the age of 15 filed on Rodriguez. Sheriff’s deputies arrested the defendant on the same charge on June 5 with the same passenger in his vehicle.

Bond on that charge was $1,500.

•Gerardo Luis Cantu was named in two separate indictments on charges of forgery, all state jail felonies.

The first indictment listed four counts of the offense with the first count being forgery, passing, and the next three counts being forgery, making.

The second indictment listed three counts of forgery, passing.

According to BPD investigators, all seven counts listed in the two separate indictments involved the cashing of checks on a First National Bank account of two local people between April 3 and 8.

Bond was $5,000 on both indictments for a total of $10,000.

•Gerardo Luis Cantu on a charge of theft of property ($1,500-$20,000), a state jail felony.

In that case, police alleged that Cantu took rods and reels from another man on Oct. 29.

Bond on that charge was $5,000.

•Felipe Ybarra, Jr. on a charge of theft of property ($1,500-$20,000), a state jail felony.

Ybarra is alleged to have been involved in the same theft cited in the indictment naming Cantu. Police reported that the offense occurred on the same day and the victim named was the same man.

Bond was $5,000.
