Brock waived arraignment and Kotter set Jan. 13, 2010, as the date to file motions in pre-trial matters. The case is set to be heard on May 17, 2010.
The former police chief was indicted by a Refugio County Grand Jury on three counts including theft by a public servant, felony misappropriation of fiduciary property and abuse of official capacity.
He is currently on administrative leave without pay.
