The plea bargain agreement also calls for Steven Ray Martin to spend 75 days in Bee County Jail and pay a fine of $500.
Martin was indicted in January on one count of indecency with a child, a second degree felony offense punishable by up to 20 years in prison.
The illegal act alleged by prosecutors apparently occurred in Bee County.
Bee County sheriff’s deputies investigated the case after they were alerted by authorities.
The plea bargain agreement, worked out by the district attorney and Martin’s lawyer, Jerry Clark, calls for Martin to be sentenced to 10 years deferred adjudication probation.
Under deferred adjudication probation, Martin’s judgment will be deferred until later, if ever. If he successfully completes the terms of his probation, he will not be judged and thus not have a criminal conviction on his record in connection with the April 11, 2008, incident.
If he fails to abide by the terms of his community supervision, he could be sentenced to the maximum time in prison allowed by law, in this case 20 years.
District Court Judge Mike Welborn agreed to accept Martin’s plea of guilt and has set a sentencing date of March 9. Welborn does not have to follow the terms of the plea bargain agreement.
