You have been sued. You may employ an attorney. You are commanded to appear by filing a written answer to the Plaintiffs' Original Petition on or before 10:00 a.m. on January 18th, 2016, that day being the first Monday after the expiration of 42 days from the date of issuance of this Citation, in the 218th Judicial District Court of Karnes County, Texas, at the Karnes County Courthouse, located at 210 W. Calvert Ave. #180, Karnes City, Karnes County, Texas. The case is Cause No. 15-12-00276-CVK styled JESUS A. TREVINO and SYLVIA A. TREVINO v. SANDRA K. PIETROSKI, ALSO KNOWN AS SANDRA LYNN KELLY-FRIED, KATHLEEN E. KELLY, AND THE UNKNOWN HEIRS OF SHARON K. PARKS, DECEASED. The Petition was filed on December 7, 2015. The attorney for the Plaintiffs is CLINTON M. BUTLER, at 114 N. Panna Maria Ave., Karnes City, Texas 78118. The nature of the suit is as follows:
Plaintiffs have filed a Suit for Specific Performance of a Contract for Deed, for Breach of Contract, and for Violation of the Texas Property Code against Defendants, asserting that Plaintiffs have fulfilled their obligations to purchase the property which Defendants have inherited an interest in described in the Contract for Deed as:
Lot V, Block 2
Being 1.213 acres, more or less, out of the F. Ruiz Grant in Karnes County, Texas, and being part of the remainder of the 360 acre tract of land conveyed to J.A. Hickok, by L.F. Hickok, et ux, by deed dated May 1, 1934, recorded in the Deed Records of Karnes County, Texas, in Volume 102, Page 216, after taking off the 177 acre tract of land conveyed by J.A. Hickok, et ux, to L.F. Hickok by deed dated November 5, 1952, recorded in Deed Records of Karnes County, Texas, in Volume 209, Page 564, said 1.213 acre tract ofland described by metes and bounds as follows:
COMMENCING at the southeast corner of the W. Mathis Hickok 696 acre tract of land in the northeast line of State Highway No. 181;
THENCE with the northeast line of State Highway No. 181, South 42°30'00" East, 1601.86 feet to a 5/8" iron rod;
THENCE North 18°42'32" East, 880.87 feet for the most southwesterly corner of this tract and POINT OF BEGINNING;
THENCE continuing North 18°42'32" East, 108.78 feet for the most northwesterly corner of this tract;
THENCE South 77°30' East, 482.84 feet to the centerline of a 40 foot access easement for the most northeasterly corner of this tract;
THENCE South 12°30'00" West, with the centerline of said 40 foot access easement, 108.14 feet for the most southeasterly corner of this tract;
THENCE North 77°30' West, 494.61 feet to the POINT OF BEGINNING.
Plaintiffs pray that the Court order specific performance of the Contract for Deed and award title to the above described property in accordance with the terms of the Contract for Deed dated April 7, 1980.
If you fail to file an answer, judgment by default may be rendered for the relief demanded in Plaintiffs' Original Petition. If you or your attorney do not file a written answer with the clerk who issued this Citation by 10:00 a.m. on January 18th, 2016, which is the Monday next following the expiration of 42 days after the issuance df this Citation, a default judgment may be taken against you.
